EverFans Acceptable Use Policy

This Acceptable Use Policy ("AUP") explains what is and is not allowed on EverFans. It applies to your use of and all Content and Services on EverFans, in addition to our other Policies. We take appropriate action when we learn of violations of this AUP, including but not limited to account termination and (where appropriate) reporting to appropriate authorities.

Capitalized terms that are not otherwise defined have the same definitions as in our Terms of Service "TOS".

General

1) Adults-only: You may only use EverFans if you are an adult.

2) Nothing illegal, fraudulent, or unauthorized: You may not use EverFans for any illegal, fraudulent, or unauthorized purposes. This prohibition includes but is not limited to doing or attempting to do any of the following: engaging in illegal activity on the Platform; Uploading illegal Content to the Platform; and violating any law or encouraging or providing instructions to another to do so.

3) No hate, no threats, no bullying: Engaging in, encouraging, or contributing in any way to hate speech, hateful conduct, abuse, threats, or bullying of any kind is strictly prohibited. This includes specifically but is not limited to doxxing, stalking, or intimidating other Users, or otherwise creating a reasonable impression that another User may not be safe. If someone is making you uncomfortable on the Platform, please block and/or report them.

4) Personal use and responsibility: You may use EverFans only for your personal use. You may not permit others to use or log in to your account, and any action taken by or on your account is attributable to you.

5) No infringement on others' intellectual property rights: Your Content and use of the Platform may not infringe on others' intellectual property rights.

6) Other disruptive behaviors: Do not engage in, encourage, or contribute to trolling, spamming, flooding, sharing other people's personal information, or other behaviors that negatively impact anyone's ability to use the Platform.

7) Access to EverFans is prohibited for anyone who is, or is required to be, a registered sex offender in any jurisdiction.

User-Generated Content

All Content

8) Rights in your Content: In general, your Content may feature only AI depictions of yourself or depictions for which you have exclusive intellectual property rights. You may include AI depictions of real individuals other than yourself and/or depictions for which someone else holds any intellectual property rights only if:

a. Such rights holders and any individuals depicted in your Content are over the age of 18 (or the age of majority in your and their jurisdiction);

b. You have obtained the explicit, documented consent of any rights holders of depictions included in your Content;

c. The Content otherwise complies with our Policies.

9) No deepfakes: You may not Upload or attempt to Upload or create material that makes unauthorized use of another person's image or likeness, commonly referred to as a "deepfake."

10) No impersonation or false claims of affiliation: Your Content may not impersonate or misrepresent your affiliation with another person (whether real or AI-generated) or entity.

11) Incorrect information and misrepresentations: You may not Upload Content with incorrect information or misrepresentations that could damage the Platform or any User or person.

12) Nothing illegal or inappropriate: Your Content must comply with the law applicable in any locale from which it is Uploaded and from which it is accessible. This includes but is not limited to Content that depicts or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate. Per our TOS, we reserve the right to remove illegal and/or inappropriate User-Generated Content from the Platform.

13) No weapons or other prohibited goods: You may not show, advertise, or promote firearms, weapons, or goods whose possession or use is prohibited or restricted.

14) No drugs or alcohol: You may not show, promote, or refer to alcohol, drugs, or drug paraphernalia.

15) No hate, no discrimination: Hateful speech and/or conduct is strictly prohibited, including but not limited to attacking or discriminating against other people based on race, ethnicity, national origin, caste, sexual orientation, gender, gender identity, religious affiliation, age, disability, or disease.

16) Trafficking and abuse prohibited: You may not use or attempt to use the Platform to promote, facilitate, or engage in human trafficking, sex trafficking or physical abuse.

17) Terrorism and extremism prohibited: You may not use or attempt to use the Platform to promote, facilitate, represent, or engage in terrorism, extremism, or terrorist or extremist groups of any kind. This includes but is not limited to terrorist organizations, organized hate groups, and criminal organizations. (Content presenting historical, educational, or newsworthy information that references such activities or groups is unlikely to violate this rule.)

18) Authenticity and quality: You may not Upload Content or engage in activities that are inauthentic, fraudulent, misleading, or reasonably considered spam or any form of unauthorized solicitation. Content or activities that artificially inflate a Creator's following, views, or interactions are also prohibited.

19) Gambling-related activities: Your Content may not contain sweepstakes, contests, or lotteries, or be otherwise related to gambling.

20) User-Generated Content is further subject to our other Policies (as updated from time to time).

Specific Terms Applicable to Adult Content

In addition to the general terms above that apply to all Content, the following apply specifically to Content that depicts sexual and/or explicit themes ("Adult Content"):

21) Adults-only: Uploading AIG-Content that depicts a minor in sexual scenarios and/or CSAM is a crime and is strictly prohibited. We have a zero-tolerance policy for such Content and report known CSAM to appropriate authorities.

22) No NCII/revenge porn: Non-consensual intimate imagery and/or so-called "revenge porn" is a crime and is strictly prohibited on EverFans. Any real individuals featured in Uploaded Content must have given their fully informed consent to the material being captured and/or memorialized in any form, and to being Uploaded on EverFans. See Para. 8 above.

23) Other prohibited Adult Content: You may not Upload any Adult Content (including but not limited to images, videos, and text) that depicts, simulates, or implies non-consensual sexual activity, blackmail, intimidation, snuff, torture, death, violence, incest, racial slurs, hate speech, or obscene themes.

24) Individuals depicted must appear sober and capable of giving consent: Anyone depicted in your Content must appear awake, sober (not intoxicated), of clear and sound mind, and appear capable of giving informed consent to any activity depicted. Prohibited depictions include but are not limited to individuals who are sleeping, unconscious, intoxicated, passed out, or hypnotized, whether real or simulated.

25) Actual or simulated illegal activity is prohibited: All depictions (whether actual, simulated, or role-played) of illegal sexual activity are strictly prohibited. This includes but is not limited to child exploitation, abuse, or harm; incest; bestiality; necrophilia; rape or sexual assault; illegal prostitution; and human trafficking.

Further Restrictions

26) You may not use EverFans to facilitate or discuss in-person meetings or off-platform transactions or interactions of any kind.

27) You must obtain our written consent before Uploading any Content:

a. that claims or implies that your Content is endorsed by another entity, individual, or by EverFans.

b. that involves or promotes third-party commercial activities or sales, including but not limited to contests, sweepstakes, product placements, advertisements of any kind.

28) You may not link to or reference on EverFans any online property that violates our TOS or Policies.

29) You may not engage in any damaging or irritating cyber activity, including spamming, sharing other people\'s personal data, linking to external media storage sites, or behaving in any way that interferes with our software, hardware, or network.

30) You may not copy content, whether by screenshotting, scraping, downloading, sharing, or gathering information from EverFans or any Creator for any reason.

31) Do not attempt to circumvent this AUP or any other Policy via any method, for example, by attempting to use codewords or other signals to facilitate violations.

32) In using EverFans, do not cause or attempt to cause anyone inconvenience, anxiety, upset, embarrassment, or serious offense.

33) Your use of EverFans is subject to our other Policies, in particular our TOS and Community Guidelines.
